Abstract

Актуальність теми дослідження зумовлена тим, що останнім часом корупція в суспільстві як явище створює реальну загрозу ефективному демократич-ному розвитку держави, підриває авторитет країни, обмежує конституційні права та свободи людини, порушує принципи вер¬ховенства права, знецінює моральні цінності. Тому питання запобігання корупції стають одними з перших на шляху побудови правової держави. Слід відмітити, що правове визначення корупції та боротьби з нею є наслідком усвідомлення корупції як специфічного способу мислення, який зумовлюється психологічною схильністю до корупційних діянь та формує спосіб життя. Цікавим є досвід зарубіжних країн, які проводять заходи запобігання корупції через психологічні та соціальні заходи, а інші через політичні та правові заходи. В більшості випадків це зумовлюється тими історичними передумовами, які сформували менталітет населення кожної окремої країни. Тому метою дослідження є визначення заходів запобігання корупції через призму психологічного сприйняття явища корупції як негативного для суспільства та визначення превентивних заходів боротьби з так званою залежністю від корупції в психологічному аспекті більш прогресивними, ніж покарання в правовому аспекті. З іншого боку, використовуючи превентивні заходи психологічного та соціального характеру необхідно вивчити можливість посилення юридичної відповідальності за нехтування використанням превентивних заходів в сфері запобігання корупції.

The relevance of the topic of the study is due to the fact that corruption in society as a phenomenon is a real threat to the effective democratic development of the state, undermines the credibility of the country, restricts constitutional rights and human freedoms, violates the principles of the rule of law, devalues moral values. Therefore, the issues of preventing corruption become one of the first on the way to building a law-governed state. It should be noted that the legal definition of corruption and combating it is a consequence of awareness of corruption as a specific way of thinking, which is predetermined by a psychological inclination to corrupt acts and forms a way of life. Interesting is the experience of foreign countries that are taking measures to prevent corruption through psychological and social measures, and others through political and legal measures. In most cases, this is due to the historical preconditions that have formed the mentality of the population of each individual country. Therefore, the purpose of the study is to identify measures to prevent corruption through the prism of psychological perception of the phenomenon of corruption as a negative for society and to identify preventive measures to combat the so-called dependence on corruption in the psychological aspect more progressive than punishment in the legal aspect. On the other hand, using preventive measures of a psychological and social nature, it is necessary to consider the possibility of strengthening legal liability for neglecting the use of preventive measures in the field of prevention of corruption.
