Короткий опис (реферат):
В монографії обґрунтовується не¬обхідність прийняття та реалізація комплексної загальнодержавної про¬грами гарантування продовольчої без-пеки на підставі правового аналізу норм та положень чинного та зарубіж-ного законодавства, дослідження меха¬нізму гарантування продовольчої без-пеки в умовах членства України у СОТ та вектору розвитку України в рамках адаптації законодавства України до законодавства ЄС. Актуальність теми дослідження обґрунтована необхідністю прискорення запровадження і дієвої вітчизняної системи забезпе¬чення продовольчої безпеки з урахуванням, але не повним копіюванням зарубіжного досвіду. І тим більш, не виконанням ультимативних рескриптів іноземних держав щодо їх інтересів відносно поставок іноземних продуктів харчування без належного контролю їх з боку спеціальних контролюючих органів Україні в сфері продовольчої безпеки України.
Дослідження знаходиться на стику декількох дисциплін, таких як аграрне, екологічне право, які є ключовими в контексті роботи, але ці норми базуються на загальних принципах, які притаманні як цивільному так і адміністративному та кримінальному праву. Якщо в аграрному праві правове регулювання та практика забезпечення екологічної безпеки продовольчої продукції в Україні визначається в рамках якості сільськогосподарської продукції. то в екологічному праві – в рамках безпеки для життя та здоров’я людей. Ще більший інтерес викликає пов’язаність обраної тематики з такими галузями науки та техніки як медицина, соціологія, політологія та економіка. Це виділяє цю тему серед інших, надає їй актуальності та новизни з огляду на перехрестність питань яких вона торкається.
The purpose of this research is a grounding of the necessity of adoption and implementation of a comprehensive national food security program based on legal analysis of norms and provisions of current and foreign legislation, the study of the food security guarantee mechanism in the context of Ukraine's membership in the WTO and the vector of the Ukraine development within the framework of the adaptation of Ukrainian legislation to the legislation of the EU. The relevance of the research topic is grounded by the necessity of accelerating the implementation and functioning of the national system of food security with regard to, but not a complete copy of the foreign experience. Moreover, failure to execute the ultimatum rescripts of foreign states concerning their interests regarding deliveries of foreign food products without proper control of special regulatory authorities in the field of food security in Ukraine.
Research lays at the crossroads of several disciplines, such as agrarian, environmental law, which are key ones in the context of the work, but these standards are based on the General principles that are inherent in both civil and administrative and criminal law. While legal regulation and practice of food products environmental security in the agrarian law in Ukraine is determined within the framework of the quality of agricultural products, in environmental law it is in the framework of people's life and health security. Even of greater interest is the associativity of selected topic with such fields of science and technology as medicine, sociology, political science and economics. This distinguishes this topic among others, gives it relevance and novelty in view of crossover of the issues, which it touches.
